1) Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

If you use the App on behalf of an organization, you represent and warrant that you have authority to bind that organization.

2) Eligibility (Adults / Children)

The App is intended primarily for adults and is not directed to children.

You must be at least:

18 years old, or
the age of majority in your jurisdiction,

to use the App.

If you are under 18 (or under the age of majority where you live), do not use the App unless a parent/guardian has reviewed and agreed to these Terms and your use is lawful where you live.

3) What the App Does

Pause Buddy is a self-guided grounding tool designed to help users pause and focus on sensory grounding when distressed. It includes:

Ultra-Fast (Emergency Interrupt) mode
One Object (Five Senses) mode
5–4–3–2–1 grounding mode
Optional Voice Mode (prompts spoken; optional voice responses)
Minimal Safety and personalization settings (e.g., disable taste/smell, no timers, gentle vs directive wording, default mode)
Before/after intensity rating
Lightweight history of sessions

4) Not Medical Advice; Not Emergency Services

The App does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. It is not a medical device.

The App is not an emergency service. If you feel unsafe, are in immediate danger, or are considering self-harm, contact your local emergency number or local crisis services immediately.

The App may display optional resource information; we do not guarantee accuracy or availability for every location.

5) Results Vary; You Are Responsible for Use

You acknowledge and agree:

Grounding techniques may not work for everyone.
Some prompts may be uncomfortable or inappropriate depending on context.
You are responsible for using safety settings and skipping any prompt that feels unsafe or unhelpful.

6) Safety Settings and Skipping

The App provides safety controls such as:

disabling taste and/or smell steps,
disabling countdown timers,
choosing prompt language style (gentle vs directive),
choosing prompt verbosity (short vs slightly guided),
selecting a default mode.

You are responsible for configuring settings and using Skip whenever needed.

7) Voice Features and Microphone

If you enable voice responses, the App may request microphone permission. Voice features are optional and you can use the App without them.

No transcript storage: The App does not save or store your spoken responses or any speech-to-text transcripts.

8) Sessions, Free Use, and Subscription

8.1 What counts as a “session”

A “session” generally means completing a grounding flow that records a before/after intensity rating in history.

8.2 Free sessions

The first 10 sessions are free.

8.3 Subscription after free sessions

After free sessions are used, continued use may require a monthly or annual subscription.

8.4 Billing and auto-renewal

Subscriptions are processed through Apple App Store or Google Play. Subscriptions may auto-renew unless canceled through store settings. We do not process your card details.

8.5 Cancellation and refunds

Cancel via store settings. Refunds (if any) are governed by the store’s policies.

9) No Accounts; Local-Only History

The App does not require login and does not create user accounts.

History is stored locally and includes only:

date/time,
mode used,
before intensity rating,
after intensity rating.

No journaling, no saved grounding objects, and no transcripts are stored.

10) Acceptable Use / Prohibited Use

You agree not to:

use the App unlawfully,
attempt to reverse engineer, decompile, or bypass security (except where permitted by law),
disrupt or interfere with App security or performance.

11) Intellectual Property

The App and its prompts, UI, and software are owned by us (or our licensors). You receive a limited, non-exclusive, non-transferable, revocable license for personal lawful use.

12) Updates; Changes; Discontinuation

We may update, modify, or discontinue the App or features at any time for maintenance, security, compatibility, legal, or business reasons.

13) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND AVAILABILITY.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION.
WE ARE NOT LIABLE FOR ANY DECISIONS YOU MAKE OR ACTIONS YOU TAKE BASED ON APP USE, INCLUDING FAILING TO SEEK PROFESSIONAL OR EMERGENCY HELP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR SUBSCRIPTIONS IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR INR 1,000 IF YOU PAID NOTHING), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

Some jurisdictions do not allow certain limitations; in those places, liability is limited to the maximum extent permitted.

15) Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of law.

16) Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Pune, Maharashtra, India have exclusive jurisdiction.

Mandatory rights carve-out: If you live in a jurisdiction with non-waivable consumer protections, those rights are not limited by these Terms to the extent they apply.

17) Changes to These Terms

We may update these Terms from time to time. The Effective Date will change. Continued use after changes constitutes acceptance where permitted.
