1) Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to these Terms (“Terms”). If you do not agree, do not use the App.

If you use the App on behalf of an organization, you represent and warrant you have authority to bind it.

2) What the App Does

Talking Diary is a private, AI-assisted voice journaling app. You record a voice entry, the App transcribes it, and (when enabled) uses AI to generate a structured reflection such as a summary, mood label, themes, values, action items, and reflection prompts.
Pro users can optionally use a “Talk to Me” chat feature scoped to a single entry.

3) Not Medical, Therapy, or Crisis Support

Talking Diary is a personal reflection tool. It is not a medical device and does not provide medical, psychological, psychiatric, therapy, counseling, diagnosis, or treatment.
If you are in immediate danger or considering self-harm, contact local emergency services.

4) AI Disclaimers and Limits

AI-generated outputs may be inaccurate, incomplete, or misleading. The App makes no guarantee of accuracy of summaries, mood labels, insights, or chat responses.
AI outputs are not clinically validated and the App makes no claims of therapeutic benefit.

“Talk to Me” Chat Rules

The AI chat is designed to be reflective and non-directive and is constrained by system instructions (e.g., not providing advice or diagnoses and not acting as therapy).
You agree not to rely on chat outputs for decisions involving health, safety, legal, or financial matters.

5) Your Responsibilities

You are responsible for:

  • what you record and store in the App,

  • securing your device and backups,

  • deciding what to export/share and where.

You agree not to use the App unlawfully or in a way that violates others’ rights (e.g., recording people without permission where required by law).

6) No Accounts

The App does not require or create user accounts, and does not require an email address or password to use journaling features.

7) Permissions

The App may request:

  • Microphone (to record voice entries)

  • Speech Recognition (for on-device transcription during recording)

  • Notifications (optional) only if you set a reminder (local notifications; no push server)

8) Free Tier and Subscription (Pro)

Free Tier

Free users can create up to 10 journal entries (hard limit). Free includes basic AI analysis, calendar view, and search limited to 5 results.

Pro Tier

Pro includes unlimited entries, unlimited search results, Insights, per-entry chat (“Talk to Me”), and export.

Pricing: Pro is offered as an auto-renewing subscription billed through the App Store / Google Play (as applicable). Current prices are $2.99 per month or $29.99 per year (plus applicable taxes). Prices may vary by country/region and may change over time.

Billing, Auto-Renewal, Cancellation, Refunds

Subscriptions are processed by Apple App Store / Google Play (as applicable). Subscriptions may auto-renew unless canceled via your store account settings. Refunds are governed by the store’s policies.
We do not receive your full payment card details.

9) Exporting Data (Pro)

Pro users can export an entry as formatted text via the system share sheet. The export may include date, summary, mood, action items, themes, values, and transcript.
Once exported/shared, the receiving app/service controls that data under its own terms and privacy policy.

10) Data Deletion

You can delete individual entries (audio + database record + related chat messages) and you can clear all data via Settings → Clear All Data.
Uninstalling the App deletes the local database and stored audio files from the App’s storage area, along with local preferences.

11) Prohibited Conduct

You may not:

  • reverse engineer or bypass protections (except where permitted by law),

  • misuse the App to violate laws or rights,

  • attempt to interfere with App operation.

12) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, including accuracy, reliability, fitness for a particular purpose, and availability.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of data, profits, goodwill, or reputation.

  • We are not liable for reliance on AI outputs.

Our total liability for any claim related to the App will not exceed the amount you paid for subscriptions in the 3 monthsbefore the event giving rise to the claim, or INR 1,000 if you paid nothing, unless applicable law requires otherwise.

14) Indemnity

You agree to indemnify and hold us harmless from claims and expenses arising from your use of the App, your content, or your violation of these Terms or law.

​

15) Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Pune, Maharashtra, India have exclusive jurisdiction.
